Justice Tagbo Anieto of High Court 3, sitting at Otuocha, in Anambra East Local Council Area of Anambra State on the first of March, 2024, in Suit No. OT/332/2023 restored the leadership of the National Executive Committee of Ogwuari Nsugbe led by Comrade Tagbo Obi-Ezeazu as the authentic National Chiarman of Ogwuari Nsugbe till 19th of August, 2025, when his tenure will expire.
This followed an Originating Summons filed by the Plaintiffs, Barrister Emeka Mokwe, Legal Adviser of Ogwuari Nsugbe, and Comrade Tagbo Obi-Ezeazu on the December second, 2023 seeking an interpretation of Ogwuari Constitution as whether it was lawful and constitutional for Ogwuari Village, Nsugbe, to conduct a fresh election while the tenure of the current Executive committee led by Comrade Tagbo Obi-Ezeazu has not expired.
The Plaintiffs sued the seven Diokpala Ogwuari and the chairman of the electoral committee as defendants also seeking an order of Mandatory injunction restraining them from conducting fresh election pending the hearing and determination of the substantive Suit.
After dissecting the Affidavits and Counter Affidavits by both the Plaintiffs and Defendants, the Court held that there was no valid election held hence the election allegedly conducted on the December 16, 2023 while this suit was pending was illegal, ineffective and without any basis.
The court also ordered that the second Plaintiff, Comrade Tagbo Obi-Ezeazu continue in office with the members of the executive committee of Ogwuari Nsugbe until their tenure expires on the 19th August, 2025.
It holds that any other executive committee of Ogwuari Nsugbe apart from the one led by Comrade Tagbo Obi-Ezeazu remains illegal and ineffective.
